Eligibility and Rules of this Skill Contest

No Purchase Necessary

The Toyota Car Control Challenge is a skill contest. It is not a sweepstakes or lottery involving random chance for success. The entries of each contestant will be judged and/or scored according to a set of rules and standards established by Advanced Car Control Techniques, (ACCT) a dba of Auto Testers, Inc.

 

No purchase of any product or service of ACCT, or its subsidiaries, the sponsors or affiliates of the contest is necessary. No purchase will change or affect the odds of winning a prize in the contest. The odds of winning a prize depend both on the ranking of the scores of the contestants as judged/recorded by the organizers and the number of contestants. Purchase is not involved in either determinate.

How the Toyota Car Control Challenge Program Works

Eligible contestants register on this web site between April 1, 2008 and July 31, 2008. Contestants will compete in three Qualifying contests, an essay of 800 words plus or minus 20 words on the subject of the importance of Attitude in avoiding crashes, a test of the contestant’s Knowledge of road rules and regulations consisting of 50 randomly selected questions from a battery of 200 questions and a test of the contestant’s crash-avoidance Skills, performing in-car exercises in cone patterns under the observation of judges. Each of the tests will be worth 300 points. Not every contestant will reach the skill-testing phase, which will be confined to the highest scorers selected from the first two tests.

 

The skill testing target population is the first 200 contestants who register for skill testing after July 1, 2008 on a first-come, first-serve basis.

The Alias and Reporting of Scores

Each registered contestant will be required to create an alias for their entry into the contest. The registered contestant whose records will be connected to the alias will remain anonymous to the public insofar as ACCT and its contractors and the sponsors are concerned. (see Privacy Policy)

Scores and Prizes

Scores of each phase of testing will be posted on the web site on a daily basis as the contest period continues. A complete list of the contestant categories, the championship series events and the prizes can be found here.

 

Eligibility to be a Contestant

All drivers must be between the ages of 16 years and 19 years on or before August 30, 2008 and reside in one of the following counties (proof of age and residency may be required):

All drivers who have a valid driver’s license or learner’s permit are eligible to enter the contest provided that:

  1. the otherwise eligible driver has never had a DUI conviction and,
  2. the otherwise eligible driver has no more that two (2) moving violation convictions recorded at the state department of motor vehicles during the past 24 months.

There may be only one entry per driver license.

 

Contestants are required to select a school to represent during the competition. The eligible schools are organized by region as follows:

To be eligible to compete for the Mom or Dad prizes an adult  contestant must have a child under their partial or full legal custody who meets the eligibility for teen drivers presented above and resides in the counties listed above and are subject to the same traffic violation limitations listed above.

Ineligibility

Employees, officers and directors of ACCT, the sponsors and any vendor engaged by either to conduct the contest are ineligible to enter the Contest or win a Prize. Also ineligible are employees of ACCT and/or the sponsor's subsidiaries, affiliates, and each of their immediate family members (including, without limitation, those persons living in the same household of each).

Substitution & Assignment

Grand Prize is not transferable. No substitution or cash redemptions of prize, however, ACCT reserve the right to substitute a prize of equal or greater value at its own discretion.

Publicity

Acceptance of any prize shall constitute the winner's consent to ACCT’s use of the winner's name, likeness, voice, opinions, prize information and hometown and state for promotional purposes in any media, worldwide, without limitation and without further payment or consideration, except where prohibited by law.

Limitations Of Liability

By participating, entrants (a): agree that ACCT, and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or contest shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation is this Contest and acceptance, possession, use or misuse of the prizes; (b) agree that ACCT and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (c) agree to be bound by the official rules and the decisions of ACCT (including but not limited to eligibility determinations) which are final and binding in all respects; and (d) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes in connection with this Contest without additional compensation, unless prohibited by law.

 

All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify ACCT from any and all such claims, including the attorneys' fees related thereto. ACCT shall not be liable for entries. ACCT is not responsible for late, lost, incomplete, inaccurate or misdirected entries, whether caused by any technical or human error which may occur in the processing of the entries in the Contest; computer system, phone line, computer equipment or computer malfunctions, software, program malfunctions or other failures, or other errors or delays; or network connections that are human, mechanical or technical in nature. Entrant further agrees that in any cause of action, ACCT and its employees and agents liability will be limited to the cost of entering and participating in the contest, and in no event shall the released parties be liable for attorneys fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. Any person attempting to defraud or in any way tamper with this contest will be ineligible for prizes and may prosecuted to the fullest extent permitted by law. ACCT reserves the right, in their sole discretion, to cancel or suspend this Contest should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the Contest. ACCT further reserves the right to modify the rules of the Contest in any way or at any time, as long as reasonable notice is given.

Disputes

Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of Florida without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the U.S. Federal and State Courts of Florida. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.

Taxes

All federal, state and local taxes, and any other costs and expenses, associated with the receipt or use of the prize are the sole responsibility of the winner.

 

This contest is VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
